Romanta Terms of Use Agreement

Effective Date: December 27, 2025

1. INTRODUCTION

By accessing or using the services offered by Romanta Dating ("Romanta," "we," "us," or "our") on the website romantadating.com (the "Website"), the Romanta mobile application (the "App"), or any other related platforms or services (collectively, the "Services"), you agree to be bound by this Terms of Use Agreement (the "Terms" or "Agreement"). This Agreement also includes our Privacy Policy, Community Guidelines, and Safety Tips, which are incorporated by reference. Please read this entire Agreement carefully before using our Services.

PLEASE REVIEW THE DISPUTE RESOLUTION PROVISIONS IN SECTION 14 BELOW CAREFULLY. THEY INCLUDE A MANDATORY ARBITRATION AGREEMENT, CLASS ACTION WAIVER, AND JURY TRIAL WAIVER, WHICH SIGNIFICANTLY AFFECT YOUR LEGAL RIGHTS.

We may update these Terms at our discretion. Your continued use of the Services after such updates constitutes your acceptance of the new Terms.

2. ACCOUNT ELIGIBILITY & USER RESPONSIBILITIES

2a. Eligibility

You may create an account only if you:

  • Are an individual (not a business entity) and are at least 18 years old.
  • Are legally qualified to enter a binding contract.
  • Have not been convicted of or pled no contest to a felony or any crime involving violence, sexual misconduct, or threats.
  • Are not prohibited by law from using our Services.
  • Will maintain only one account and have not previously been removed from our Services for violations.
2b. Your Responsibilities

You agree to:

  • Comply with these Terms and all applicable laws.
  • Provide accurate information and update it as necessary.
  • Treat all other users, our employees, and our matchmakers with respect and courtesy.
  • Maintain the security of your account login information.
  • Review and adhere to our Community Guidelines and Safety Tips.
  • Use the Services only for their intended purpose of forming genuine romantic connections.
2c. Prohibited Actions

You agree you will not:

  • Misrepresent your identity, age, relationship status, or any other material fact.
  • Harass, bully, stalk, intimidate, or harm other users.
  • Use the Services for any commercial purpose, including solicitation, advertising, or engaging in "sugar daddy/sugar baby" arrangements.
  • Share the personal contact or financial information (e.g., home address, private phone numbers, credit card details) of yourself or others on your public profile.
  • Post or share Prohibited Content as defined in Section 2d.
  • Use automated systems (bots, scripts, etc.) to interact with the Services.
  • Attempt to circumvent our payment systems or purchase features outside of official channels.
2d. Prohibited Content

You may not upload or share content that is:

  • Sexually explicit, pornographic, or violent.
  • Abusive, hateful, threatening, defamatory, or discriminatory.
  • Illegal or that promotes illegal activity.
  • Related to commercial activities, contests, or multi-level marketing.
  • Infringes upon any third party's intellectual property or privacy rights.
  • Involves the unauthorized image or likeness of another person.

3. SERVICES OVERVIEW: DATING PATH AND MATCHING PATH

Romanta offers two distinct service models, as described on our website:

  • The Dating Path: A self-directed online dating community where users can create profiles, discover others, and connect using various communication tools.
  • The Matching Path: A premium, curated service where users must apply and be interviewed by a professional Romanta matchmaker. Upon acceptance, users gain access to a vetted pool of members and receive personalized match introductions.

Your use of either Path is governed by these Terms. Specific features, pricing, and refund policies for each Path are detailed in the relevant sections of the Services and in Section 8 (Purchases).

4. AI-POWERED FEATURES

Our Services utilize artificial intelligence and machine learning ("AI") to provide features such as personalized coaching tips, profile suggestions, and conversation aids ("AI Output"). You acknowledge and agree that:

  • AI Output is generated for informational and assistance purposes only. It may be inaccurate, incomplete, or unsuitable. YOU ARE SOLELY RESPONSIBLE FOR YOUR DECISIONS, ACTIONS, AND INTERACTIONS WITH OTHER USERS.
  • Romanta does not warrant the accuracy, reliability, or appropriateness of any AI Output. Your reliance on such information is at your own risk.
  • To provide and improve these AI features, you grant Romanta a license to use, process, and analyze your non-sensitive account data and content. The use of sensitive personal data for AI training is governed by our Privacy Policy.

5. INAPPROPRIATE CONTENT & REPORTING

Romanta is committed to a safe and respectful community. You may report inappropriate user behavior or content through tools within the Services or by contacting Customer Service. We may investigate reports and take action, including suspending or terminating accounts, at our sole discretion. Our enforcement actions may involve both automated tools and human review.

6. PRIVACY

Your privacy is important. Our collection and use of your personal information are governed by our separate Privacy Policy. By using the Services, you consent to such collection and use.

7. RIGHTS YOU GRANT ROMANTA

By creating an account and posting content, you grant Romanta a worldwide, royalty-free, sublicensable, and transferable license to host, store, use, display, reproduce, modify, and distribute Your Content for the purpose of operating, developing, providing, promoting, and improving the Services. This license continues for a reasonable period after you delete content or your account for purposes such as backup, archival storage, and legal compliance. You represent and warrant that you own all content you post or have the necessary rights to grant us this license.

8. PURCHASES, SUBSCRIPTIONS, AND REFUNDS

  • General: You may purchase subscriptions or virtual items ("Virtual Items") for the Dating Path, or a subscription for the Matching Path. Prices are subject to change. Virtual Items are digital licenses, not property. You have no ownership interest. Romanta may manage, modify, or eliminate Virtual Items at any time.
  • Automatic Renewal: Subscriptions automatically renew at the end of each billing period until you cancel.
  • Cancellation: You may cancel a subscription at any time through your account settings. Cancellation stops future billing but does not entitle you to a refund for the unused portion of the current period, except as required by law.
  • Virtual Items: Virtual Items (e.g., "Boosts," "Super Likes") are licensed for use within the Services, are non-transferable, and are NON-REFUNDABLE under any circumstances.
  • Special Refund Terms (Matching Path): Due to the significant upfront cost and personalized service involved, ALL FEES FOR THE MATCHING PATH ARE NON-REFUNDABLE once the matchmaking interview or first match introduction has occurred, except as explicitly prohibited by applicable law.
  • Free Trial: Your subscription may start with a free trial. You will be charged at the end of the free trial unless you cancel before the trial period ends, in accordance with these Terms.
  • External Service Purchases: If you purchase a subscription through the Apple App Store or Google Play Store, payment is managed by that external service. You must cancel or manage such subscriptions through your account with that service, not through Romanta.

9. ACCOUNT TERMINATION

You may delete your account at any time via your account settings. Romanta reserves the right to suspend or terminate your account immediately, without refund, if we believe you have violated these Terms or misused the Services.

Termination of Matching Path Services: Notwithstanding the above, Romanta may immediately terminate a user's access to the Matching Path, without refund, if the user: (i) fails to cooperate in good faith with the matchmaking process (e.g., repeatedly misses scheduled interviews, provides materially false information); (ii) exhibits abusive, threatening, or harassing behavior towards any Romanta matchmaker or employee; or (iii) misuses the service to contact matched members for commercial purposes or outside the intended romantic scope.

10. EVENT PARTICIPATION & RELEASE

Participation in any Romanta-sponsored virtual or in-person event ("Events") is voluntary. You agree that:

  • You participate at your own risk. Romanta is not responsible for the conduct of any event attendee or third-party vendor.
  • To the fullest extent permitted by law, you RELEASE, INDEMNIFY, AND HOLD HARMLESS Romanta, its affiliates, officers, and employees from any and all claims, liabilities, or damages (including for personal injury, illness, or property damage) arising from your participation in or attendance at any Event, except where directly caused by the gross negligence or willful misconduct of Romanta.

10A. THIRD-PARTY & COMMUNITY EVENTS

Romanta may list or promote events organized by third parties or community members ("Third-Party Events"). You acknowledge and agree that:

  • No Endorsement or Control: Romanta does not organize, supervise, sponsor, or control Third-Party Events. Listing an event does not constitute our endorsement, warranty, or guarantee of its safety, quality, or legality.
  • Your Responsibility: Your decision to attend any Third-Party Event is made at your sole discretion and risk. You are solely responsible for:
    1. Researching the event, its organizers, venue, and safety protocols before attending.
    2. Verifying all event details (time, location, cost, age restrictions) directly with the event organizer.
    3. Your personal safety, conduct, and well-being before, during, and after the event.
    4. Any payments made directly to the event organizer.
  • Release of Liability: To the fullest extent permitted by law, you release, indemnify, and hold harmless Romanta, its affiliates, and their respective officers from any and all claims, liabilities, or damages arising from your attendance at or participation in any Third-Party Event.

This section supplements, but does not replace, the general release in Section 10 for Romanta-hosted events.

11. DISCLAIMER OF WARRANTIES & LIMITATION OF LIABILITY

  • "AS IS" Service: THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT GUARANTEE THAT THE SERVICES WILL BE UNINTERRUPTED, SECURE, ERROR-FREE, OR MEET YOUR EXPECTATIONS.
  • Service-Specific Disclaimers:
    1. The Dating Path: ROMANTA'S ROLE IS SOLELY AS A PLATFORM PROVIDER. WE MAKE NO REPRESENTATIONS OR WARRANTIES REGARDING THE SUITABILITY, CONDUCT, OR VERACITY OF ANY USER. ALL INTERACTIONS ARE AT YOUR SOLE RISK. ROMANTA DOES NOT CONDUCT CRIMINAL BACKGROUND OR IDENTITY VERIFICATION CHECKS ON DATING PATH USERS.
    2. The Matching Path: WHILE ROMANTA CONDUCTS AN INTERVIEW AND VETTING PROCESS FOR THE MATCHING PATH, WE DO NOT WARRANT OR GUARANTEE THE SUCCESS OF ANY MATCH, THE ACCURACY OF INFORMATION PROVIDED BY MATCHED MEMBERS, OR THE SAFETY OF IN-PERSON MEETINGS. THE MATCHMAKER'S ROLE IS THAT OF A FACILITATOR, NOT A GUARANTOR.
  • Limitation of Liability: TO THE FULLEST EXTENT PERMITTED BY LAW, ROMANTA'S AGGREGATE LIABILITY TO YOU FOR ANY CLAIM SHALL NOT EXCEED THE GREATER OF (I) THE AMOUNT YOU HAVE PAID TO ROMANTA IN THE LAST 12 MONTHS, OR (II) ONE HUNDRED U.S. DOLLARS ($100). IN NO EVENT SHALL WE BE LIABLE FOR ANY INDIRECT, INCIDENTAL, OR CONSEQUENTIAL DAMAGES.
  • Jurisdictional Limitations: SOME JURISDICTIONS, INCLUDING CALIFORNIA, DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES. THEREFORE, THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU WHERE PROHIBITED. IN SUCH JURISDICTIONS, ROMANTA'S LIABILITY WILL BE LIMITED TO THE GREATEST EXTENT PERMITTED BY LAW.

12. INDEMNIFICATION

You agree, to the extent permitted by law, to indemnify, defend, and hold harmless Romanta and its affiliates from and against any claims, liabilities, and expenses arising from: (a) your use of the Services; (b) your violation of these Terms; (c) Your Content; or (d) your interaction with any other user.

13. GOVERNING LAW & VENUE

This Agreement and any disputes shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law principles. The United Nations Convention on Contracts for the International Sale of Goods does not apply.

14. DISPUTE RESOLUTION & ARBITRATION

  • 14a. Informal Resolution. Before filing a claim, you agree to try to resolve the dispute informally by contacting us at info@romantadating.com. We will try to resolve the dispute within 60 days.
  • 14b. Arbitration Agreement. If informal resolution fails, you and Romanta agree to resolve any dispute through BINDING INDIVIDUAL ARBITRATION administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, except as provided herein. ARBITRATION MEANS YOU WAIVE YOUR RIGHT TO A JURY TRIAL AND TO PARTICIPATE IN A CLASS ACTION OR REPRESENTATIVE PROCEEDING. An arbitrator can award the same damages and relief as a court.
  • 14c. Exceptions. This arbitration agreement does not require arbitration of: (i) individual claims in small claims court; (ii) claims that applicable law states cannot be subject to arbitration (e.g., certain claims of sexual assault or harassment under the Ending Forced Arbitration of Sexual Assault and Sexual Harassment Act); or (iii) actions to enforce intellectual property rights.
  • 14d. Opt-Out Procedure. YOU CAN OPT OUT OF THIS ARBITRATION AGREEMENT WITHIN 30 DAYS OF FIRST ACCEPTING THESE TERMS BY SENDING A WRITTEN NOTICE TO: Romanta Legal, 17401 Greentree Drive Riverside CA 92503, or by email to: info@romantadating.com (with "Arbitration Opt-Out" in the subject line). Your notice must include your name, address, the email associated with your account, and a clear statement of your wish to opt out. If you validly opt out, the arbitration provisions will not apply to you.
  • 14e. Venue for Litigation. If the arbitration agreement is found not to apply to you or your claim, or if you validly opt out, you agree that any judicial proceeding will be brought exclusively in the state or federal courts located in Los Angeles County, California, and you consent to personal jurisdiction there.

15. GENERAL PROVISIONS

  • Entire Agreement. These Terms, with our Privacy Policy, Community Guidelines, and Safety Tips, constitute the entire agreement between you and Romanta regarding the Services, superseding any prior agreements.
  • Severability. If any part of these Terms is found unenforceable, the rest will remain in full force and effect.
  • No Waiver. Our failure to enforce any right or provision of these Terms will not be considered a waiver.
  • Assignment. We may assign our rights and obligations under these Terms. You may not assign your rights without our prior written consent.
  • Force Majeure. We will not be liable for any failure to perform our obligations hereunder where such failure results from any cause beyond our reasonable control, including acts of God, war, terrorism, riots, embargoes, internet or telecommunications failures, or acts of civil or military authorities.
  • Electronic Communications. By using the Services, you consent to receive all communications, agreements, and notices from us electronically (e.g., by email, in-app notification).
